Article 264

Interpretation

In this Part, “Finance Commission” means a Finance Commission constituted under article 280.

Draft Article 247, Draft Constitution of India 1948

In this Part, unless the context otherwise requires,-

(a) “Finance Commission” means a Finance Commission constituted under article 260 of this Constitution;

(b) “State” does not include a State for the time being specified in Part II of the First Schedule;

(c) References to States for the time being specified in Part II of the First Schedule shall include references to any territory specified in Part IV of the First Schedule and any other territory comprised within the territory of India but not specified in that Schedule.

In this Part, unless the context otherwise requires,—

(a) “Finance Commission” means a Finance Commission constituted under article 280;
(b) “State” does not include a State specified in Part C of the First Schedule;
(c) references to States specified in Part C of the First Schedule shall include references to any territory specified in Part D of the First Schedule and any other territory comprised within the territory of India but not specified in that Schedule.

SUMMARY

The proposed Draft Article provided an interpretation or explantion of the terms ‘Finance Commission’ and ‘State.’

There was no substantial debate on the Draft Article. Draft Article 247 was adopted on 4th August,1949.

It was later substituted by the Constitution (Seventh Amendment) Act, 1956.
