The situation in India, even if it may not be supposed to be normal, is far better than the situation in Japan. But, the House has shown its unwillingness to give our people those guarantees of liberty that the people of Japan have been provided with notwithstanding the, extraordinary situation existing there. If the article under discussion is passed, the Central Government and the Provincial Governments will have the right of detaining persons under special laws. We shall be far behind the United States Constitution or the Japanese Constitution in regard to this matter. In these circumstances, I think it is necessary that we should restrain the power of the executive to detain persons without trial so as to ensure that the detainees are not kept in detention for an indefinite length of time. This is the least that we can do for those who are deprived of their liberty.
