It is not, with great respect, a safeguard. ‘Safeguard’ means a political safeguard for a community which has been provided, but fundamental right belongs to every citizen and if his right is infringed the only remedy that he has is to go to the Supreme Court. Supposing an officer is invested with the power to investigate into it, it has no value.
