We have also to consider the effect of articles 256 and 257. In my humble opinion, Sir, article 256 is clothed in such general words that we cannot say that a particular dereliction of duty alone can attract this drastic provision. Article 256 runs as follows: “The executive power of every State shall be so exercised as to ensure compliance with the laws made by parliament and any existing laws which apply in that State and the executive power of the Union shall extend to the giving of such directions a to State as may appear to the Government of India to be necessary for that purpose.”
